Protecting Those Who Are Not Able to Protect Themselves
Are you concerned that an incapacitated loved one or minor child is not receiving the complete care that he or she needs? Are you worried that his or her financial resources are not being properly managed? Guardianships and conservatorships can ensure that the needs of a minor child or incapacitated person are taken care of properly.
The first step in initiating a guardianship or conservatorship proceeding is to consult a Minnesota attorney experienced and skilled in this area of the law. It is difficult for a person to proceed without the assistance of a lawyer due to the complexity of Minnesota laws and court rules relating to guardianships and conservatorships. The attorneys at Mundahl and Wagner can help with proceedings to appoint guardians and conservators and can also suggest less restrictive alternatives that may fulfill the needs of the person you are trying to protect.
In a guardianship, a person is appointed by a court to be the guardian of a person and the estate of that person because of an inability to legally act on his or her own behalf due to minority or mental or physical incapacity. The guardian manages financial resources and/or makes decisions for an incapacitated person or minor child. The role of the guardian typically includes arranging for the necessities of life such as food, housing and health care, and paying for them from the protected person's financial resources.
A conservatorship is similar to a guardianship except that it can be over the person only, or over the estate only, or over both the person and the estate. In addition, a conservatorship is less restrictive of the protected person's civil rights. For example, in a guardianship, the protected person may lose the ability to vote or to marry, but in a conservatorship, those rights remain intact.
We can discuss the specifics of both with you during an initial consultation with our firm. At the estate planning and family law offices of Mundahl and Wagner, P.A., our caring lawyers have safeguarded the interests of vulnerable adults and children for decades.
